With all the attention to the voting on the Tax Bill, the shameful antics of sexual predators in Hollywood and DC, and the shocking decision of the jury in San Francisco something treasonous has been happening under the radar.  It seems FORMER-President Obama has decided to travel around the world undercutting President Trump and the American People.  Now, you might think it’s no big deal, right?  However, those he has been meeting with may not have the best interest in mind for the United States of America.

So, I ask you, is Obama doing this in violation of the Logan Act? Let’s see what The Logan Act is all about.

The Logan Act

(1 Stat. 613, 18 U.S.C. § 953, enacted January 30, 1799) is a United States federal law that criminalizes negotiation by unauthorized persons with foreign governments having a dispute with the United States. The intent behind the Act is to prevent unauthorized negotiations from undermining the government’s position. The Act was passed following George Logan’s unauthorized negotiations with France in 1798 and was signed into law by President John Adams on January 30, 1799. The Act was last amended in 1994, and violation of the Logan Act is a FELONY.

To date, only two people have ever been indicted for violating the Act’s provisions. However, no person has ever been prosecuted for alleged violations of the Act.

Once such instance of concern was when Barack Obama met with South Korea’s new leader almost immediately after a meeting with President Trump.


The Korea Herald reports:

“President Moon Jae-in renewed his resolve to pursue sanctions and dialogue to tackle North Korea’s nuclear program during a meeting with former US President Barack Obama on Monday, saying now is the “last chance” for the regime to return to the negotiating table. During the 40-minute talk, Moon shared the results of his recent summit with his incumbent US counterpart Donald Trump, asking for Obama’s advice on ways to advance the relationship.”

This could be considered a violation of the Logan Act as defined by Cornell Law School:  Any citizen of the United States, wherever he may be, who, without authority of the United States, directly or indirectly commences or carries on any correspondence or intercourse with any foreign government or any officer or agent thereof, with intent to influence the measures or conduct of any foreign government or of any officer or agent thereof, in relation to any disputes or controversies with the United States, or to defeat the measures of the United States, shall be fined under this title or imprisoned not more than three years, or both.

Nevertheless, the New York Times reports the history of prosecuting people under the Logan Act is practically unheard of as it seems to be what is called a dead letter, which means a law that remains on the books but is never enforced.

A study by the Congressional Research Service in 2015 stated no one has ever been prosecuted under the statute and identified only one time of an indictment under the law. In 1803, the United States attorney in Kentucky managed to get a grand jury indictment of a Kentucky farmer. This farmer had written an article in support of creating a separate nation in the territory west of the expanding United States. He had written this new nation would be an ally of France. However, the prosecutor eventually dropped the case. Recently, a scholarly paper posted online by a Federal Appeals Court law clerk identified a second apparent such indictment of the reported arrest in 1852 of a man who wrote a letter to the president of Mexico.


With all the media buzz about the Michael Flynn guilty plea and how the Logan Act should be used, I wonder what those in the MSM would think about it being used against former President Obama?  The Progressives always want to claim a first in things, so MAYBE OBAMA SHOULD BE THE FIRST FORMER PRESIDENT TO BE INDICTED AND PROSECUTED UNDER THE LOGAN ACT!!

Obama needs to keep his nose out of dealing with World Leaders and honor the tradition of past Presidents by fading into the background.  He needs to stick with golfing, hanging out with his Hollywood and Music buddies, and leave the job of President to President Donald J Trump.  Former President Obama has done quite enough damage for one lifetime. He is no longer the President, and it’s time he realizes that fact.
